Preparing for 2024

New year, new regulations, same old story. Following are some tasks employers are advised to undertake as the new year begins, courtesy of Cooley: 

  • Review and revise your employee handbooks and policies – Remember that the current NLRB is generally not the friend of employers, so any work rules should be examined to ensure they do not infringe on employee rights.  

  • Review your restrictive covenants –Check the article on non-competes in “Compliance Corner”; that ban gradually spreading. 

  • Review your arbitration agreements (if any) – One tool for employers is to ensure that any arbitration agreement is compliant with the Federal Arbitration Act (FAA), which can preempt state laws when both are in play. 

  • Take stock of your relationships  

  • Audit your artificial intelligence
