EEOC – Pay Data Reporting Update
In 2017, under the Obama Administration, EEOC instituted a plan to collect pay data; after some stops and starts, it was discontinued because of both administrative burden and data unreliability. Now EEOC has proposed (in the “2024 Spring Regulatory Agenda”) reinstating the program at some point in the relatively near future. Two points of information: (1) EEOC states they will seek public comment, so employers should be prepared to provide some when it is requested; (2) the “2024 Spring Regulatory Agenda” – by rough count – has approximately 1900 different agency proposals for regulations.
