Dramatic Change to FSLA Pending?      

The Biden Administration has completed its review of the DOL revision to the minimum salary level for exemption under the Fair Labor Standards Act (FLSA), which means the rule could be published early as this month (April). However, the dollar figures have apparently NOT been finalized, although they are close, because DOL is waiting for more recent BLS data. 

Under the rule as it now stands, the minimum salary for exemption would be $55,068, and the minimum salary for “Highly Compensated Employees” would be $143.988. 

Court challenges are expected, but their effect on the implementation of the new regulations is uncertain. Therefore, employers are advised to start preparing for the financial impact of these changes now, because they could well be substantial.
