Other Side of the Coin

A Catholic benefits association in North Dakota was granted a preliminary injunction against EEOC. The agency was trying to enforce the final rule of the Pregnant Workers Fairness Act, which would have required the association to act in violation of their sincerely-held beliefs. Specifically, EEOC cannot require the plaintiffs “to speak favorably about or refrain from speaking against abortion, fertility treatments or gender transition when such actions are contrary to their faith; to “use pronouns inconsistent with a person’s biological sex”; or to “allow persons to use private spaces reserved for the opposite sex,” whereas doing so would “chill” the exercise of their faith by forcing them to choose between exercising that or complying with federal regulations.
