Non-Disclosure Agreements (NDAs) Also Under Scrutiny     

More jurisdictions are also banning or limiting non-disclosure agreements, especially when a negative employment environment is involved. A police department employee in New Jersey had signed an NDA but later described a hostile work environment in an interview. She was sued for violating the NDA, which was signed after a previous lawsuit she had filed against the department was settled. The police department lost this suit because NJ laws had been changed in 2019 to ban “provisions in employment contracts that waive rights or remedies” and “agreements that conceal details relating to discrimination claims.”
